Terms of service

These terms of use and sale (the “Terms”) govern access to and use of the Vignette application and related services (the “Service”). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

1. Publisher

The Service is published by Psartech, publisher of the Vignette application, reachable at contact@getvignette.app.

2. The Service

Vignette turns the photos you import into studio portraits generated by artificial intelligence, intended in particular to serve as wallpapers, and lets you order paper prints of them. Images are produced by an AI model: every result is unique and by nature unpredictable. We do not guarantee any particular rendering, likeness or level of quality. For each generation, the Service produces several versions of the portrait and you choose the one you keep; the others are deleted.

3. Account

• Access requires an account, created through Sign in with Apple. You are responsible for any use made from your account.
• You must be at least 15 years old, or the age of digital majority in your country, and have the legal capacity to enter into a contract.
• You can delete your account at any time from the app. See the privacy policy for how your data is handled.

4. Credits

• Generations are paid in credits, bought through In-App Purchases handled by Apple. The price shown at the time of purchase prevails.
• A generation in standard quality costs 1 credit and produces up to two versions; a generation in high quality costs 5 credits and produces up to three versions. Upscaling a creation to high quality costs 5 credits. The exact cost is shown in the app before confirmation. A trial credit may be offered at sign-up.
• After the generation, you choose the version you keep; the others are deleted from our servers. If you make no choice within seven days, the first version is kept automatically and the others are deleted. Your choice does not change the number of credits used.
• Credits never expire, are strictly personal, non-transferable and have no monetary value outside the Service. They can neither be exchanged nor refunded in cash.
• A used credit (generation started) corresponds to a digital service supplied immediately, with your express consent: it is therefore non-refundable. Refund requests for a credit purchase are handled by Apple under its own terms.
• If a generation fails for a technical reason on our side, the corresponding credit or credits are automatically returned to your balance.

5. Your photos and your creations

• You warrant that you hold all rights to the photos you import and that you have obtained, where applicable, the consent of the people shown in them. You undertake not to import the image of a third party without their consent.
• You grant us a limited licence, for the time strictly necessary for processing, to transmit your photos to our AI provider and produce the requested creation. Your imported photos are deleted after processing (see the privacy policy).
• The generated creations belong to you for personal and commercial use, within the limits of applicable law and these Terms. Given the way they are produced by AI, their protection under copyright may be uncertain and similar results may be generated for other users.

6. Fine-art prints (sale)

• You can order a paper print of an eligible creation. Payment is made by card through Stripe; printing and shipping are handled by our provider Prodigi.
• Print prices and delivery costs are shown in the app before payment, all taxes included. Tracked delivery is offered within the European Union. Printing and shipping times are indicative.
• Right of withdrawal. Prints are made to order from your creation and are therefore clearly personalised. As such, the Luxembourg Consumer Code excludes this type of goods from the right of withdrawal: prints cannot be returned under the 14-day withdrawal period.
• Defective or non-conforming product. If a print is damaged, defective or does not match the order, contact us at contact@getvignette.app within a reasonable time, with a photo: we will reprint it or refund you. The legal guarantees of conformity and against hidden defects apply.

7. Acceptable use

You undertake not to use the Service to:

• import or generate content that is illegal, hateful, defamatory, sexual involving minors, or that infringes the rights of others;
• impersonate a person, or create misleading images likely to cause harm;
• circumvent, overload or disrupt the Service, or attempt to extract how it works by automated means.

We may suspend or close an account in the event of a breach, without this giving rise to a refund of credits acquired in violation of these Terms.

8. Availability and warranties

The Service is provided “as is” and “as available”. We do not guarantee that it will be free of interruptions or errors, nor that creations will meet any particular expectation. We may change, suspend or discontinue all or part of the Service.

9. Liability

To the extent permitted by law, our liability under the Service shall not exceed the amounts you have paid us over the last twelve months. Nothing in these Terms limits a liability that cannot legally be limited (in particular personal injury or gross negligence). You remain solely responsible for the content you import and for the use you make of your creations.

10. Governing law and disputes

These Terms are governed by Luxembourg law, without prejudice to the mandatory provisions protecting consumers in their country of residence. In the event of a dispute, you can contact us to seek an amicable solution. As a consumer, you may also use, free of charge, a competent consumer alternative dispute resolution body in Luxembourg. Failing an amicable resolution, the dispute falls under the competent Luxembourg courts, subject to the rules of jurisdiction protecting consumers.

11. Changes

We may modify these Terms. For any significant change, the date above is updated; continued use of the Service constitutes acceptance of the version in force.
